1  General Notices

1.1  Mission Arts acknowledge the traditional custodians - the Djiru people - of the land upon which the Mission Beach Community Arts Centre is located.

1.2  This website has been developed with the generous support of the Queensland Community Foundation.

1.3  Mission Arts is a non-political not-for-profit Incorporated Association. Views of individual artists and performances are solely their own.

1.4  Mission Arts is a fully volunteer-run organization and receives no regular funding from any level of government.

1.5  "We"/"us" refers to Mission Arts and/or its partner organizations (ClubExpress and SquareAu), depending on the context.

1.6  "You"/your" refers to a Mission Arts member, customer, user or other interested party or stakeholder.

2  Legal Jurisdiction

2.1  The Mission Beach Community Arts Centre Inc. ABN 86 565 769 599 ("Mission Arts") is a not-for-profit community association, incorporated in the State of Queensland, Australia.

2.2  Mission Arts operates under the legal jurisdiction of the laws of Australia and the State of Queensland.

2.3  The Mission Arts constitution ("The Rules") is available for Members to peruse online in the Document Library.

3  Copyright

3.1  All content on this website is the original work of Mission Arts and our member artists.

3.2  Under Australian Law copyright protection is inherent in all work. Further information about Australian copyright law is available from the National Library of Australia which states, inter alia:
"In Australia, copyright applies to both published and unpublished works, and protection is automatic as long as certain basic requirements are met. There is no copyright registration process and an individual does not need to claim copyright by including the copyright symbol and their name on a work (such as © Author Name Year). Copyright is not dependent on aesthetic or literary merit and protects materials that are utilitarian, short or mundane."

3.3  All rights reserved. In particular:

3.4  Any high-resolution images (or other works) available on this website shall not be reproduced at high-resolution via any means, whether electronic or hardcopy, without the explicit written permission of the copyright owner/s.

3.5  No works available from this website shall be re-sold by 3rd parties under any circumstances.

3.6  Any allowed usage must include attribution to the copyright owner/s and include statements equivalent to these.

3.7  Some aspects of this website are copyright by our partner ClubExpress.

4  Data Privacy and Protection

4.1  Mission Arts and our partners ClubExpress and SquareUp shall never sell, barter, trade or otherwise share member or non-member data with 3rd parties. We will never contact members or non-members directly except as part of the official business of our organization (for example, to send members a scheduled renewal notice).

4.2  The Mission Arts constitution ("The Rules") requires Mission Arts to maintain and provide lists of all current members' names, addresses and certain other information, to other members, so that they may be appraised as to who the other members of the association are.  Refer section 13 "Register of members" of The Rules for details.

5  Data Collection

5.1  We collect data solely for conducting the official business of Mission Arts. For example, we collect information about your:

- name, address, telephone and email addresses: so that, for example, we can communicate with you, and we can maintain accurate records of your membership status;

- emergency contacts and medical history: solely so that we can render assistance in the event of an incident on-site;

- age, gender and postcode: so that we can develop anonymised demographic statistics about our members and customers: this information is extremely beneficial when applying for grants, and to measure the extent to which we are progressing towards the targets set in our strategic plans and business plans.

6  Data Retention and Disposal

6.1  We will dispose of information pertaining to you upon your written instruction to us to do so.  Alternatively, you may use the online tool available within your Member Profile.

7 Product Quality

7.1  Most of our items for sale are handmade unique works of art. As such, minor imperfections, variations between items, and variations between items and their depiction on this website are of the essence of the products and to be expected.

7.2  Rendition of colour is necessarily imprecise in all online imaging technologies.

7.3  We reserve the right to not offer refunds or exchanges simply on the grounds of change-of-mind.

7.4  We offer almost all of our products for sale as agent on behalf of our supplier artists, on consignment. As such, we generally must confer with the supplier before agreeing to offer refund or exchange.

7.5  As agent on behalf of our suppliers, our liability is limited to simply the role of selling agent.

7.6  The best way to negotiate refund or exchange or exchange for gift voucher is in person or via telephone during our normal advertised shop opening hours. Please be patient and remember that we are all volunteers seeking to assist you and the local arts community. Code of conduct applies.

8  Online Shop

8.1  Delivery: All prices listed EXCLUDE delivery costs. Artworks, by their nature, are very varied in their packing and delivery requirements and costs. Individual quotation from providers is always required. We will negotiate this with you after you complete the checkout ordering process.

8.2  Availability (pickup and delivery): We endeavour to have items purchased available for pickup at Mission Arts on our next business day after order, with the following exceptions:

- if the item is displayed offsite: this will generally take a little longer for us to retrieve and reposition back to Mission Arts;

- if the item is part of an exhibition: item will not be available until after the advertised end of the exhibition;

- if the item is part of an Artist of the Month display: item will not be available until after the end of the month.

8.3  Pickup: Please indicate when you wish to collect the item/s in the Notes section of the Checkout screen.

8.4  NFS: If price is marked as $0 or FREE these items are Not For Sale.
